AN ACT to amend the executive law, in relation  to  standards  for  land
  clearing

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 378 of the executive law is amended by adding a new
subdivision 17 to read as follows:
  17. STANDARDS FOR LAND CLEARING  REQUIRING  THAT  ANY  PROPERTY  BEING
CLEARED  OF DEBRIS AS DEFINED BY 6 NYCRR 360-1.2(B)(94) FOR THE PURPOSES
OF COMMERCIAL OR RESIDENTIAL BUILDING CONSTRUCTION BE DONE IN  A  MANNER
THAT PROHIBITS THE BURYING OF TREES AND/OR STUMPS BENEATH THE SURFACE OF
THE PROPERTY ITSELF.
  S 2. This act shall take effect immediately.
