AN ACT to amend the public health law, in relation to nurse practitioner
  services provided by home care agencies

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 3614 of the public health law is amended by adding
a new subdivision 3-d to read as follow:
  3-D. HOME CARE-PRIMARY CARE INITIATIVE.  THE COMMISSIONER, SUBJECT  TO
THE  APPROVAL  OF  THE  DIRECTOR  OF THE BUDGET, AND NOTWITHSTANDING ANY
INCONSISTENT PROVISION OF THIS CHAPTER OR  THE  DEPARTMENT'S  RULES  AND
REGULATIONS,  IS  AUTHORIZED  TO  ADJUST  OR TO APPROVE SPECIAL RATES OF
PAYMENT FOR  REIMBURSEMENT  PROVIDED  UNDER  THIS  SECTION  AND  SECTION
FORTY-FOUR  HUNDRED  THREE-F  OF THIS CHAPTER FOR THE PROVISION OF NURSE
PRACTITIONER SERVICES THROUGH HOME CARE AGENCIES UNDER A HOME  CARE-PRI-
MARY  CARE  INITIATIVE.  SUCH  INITIATIVE  SHALL  BE FOR THE PURPOSES OF
PROVIDING OR ENHANCING PRIMARY CARE TO  HOME  CARE  PATIENTS,  INCLUDING
HOUSE-CALLS  TO  PATIENTS WHO ARE HOMEBOUND OR WHEN IN-HOME PRIMARY CARE
WOULD OTHERWISE FACILITATE ACCESS,  QUALITY  AND  COST-EFFECTIVENESS  OF
CARE,  INCLUDING  OVERCOMING  GEOGRAPHIC  RURAL/INNER-CITY  BARRIERS  TO
PRIMARY CARE. SUCH INITIATIVE SHALL ALSO TARGET PREVENTION OF  AVOIDABLE
HOSPITALIZATIONS,  REHOSPITALIZATIONS, EMERGENCY ROOM NEED AND LONG TERM
INSTITUTIONALIZATION.
  THE COMMISSIONER, IN CONSULTATION WITH REPRESENTATIVES  OF  HOME  CARE
AGENCIES  AND MANAGED LONG TERM CARE PLANS, SHALL ESTABLISH CRITERIA AND
PROCEDURES FOR THE IMPLEMENTATION OF THIS SUBDIVISION.
  S 2. This act shall take effect immediately.
