AN ACT to amend the racing, pari-mutuel wagering and breeding law, in
relation to the weight of consideration given to economic activity and
business development when considering the siting of new facilities
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivisions 7, 8, 9 and 10 of section 1306 of the racing,
pari-mutuel wagering and breeding law, as renumbered by chapter 175 of
the laws of 2013, are renumbered subdivisions 8, 9, 10 and 11 and a new
subdivision 7 is added to read as follows:
7. DETERMINE THE EXTENT OF THE PUBLIC OPPOSITION IN THE HOST AND
SURROUNDING MUNICIPALITIES OF THE SITING.
S 2. The opening paragraph of subdivision 1 and the opening paragraph
of subdivision 2 of section 1320 of the racing, pari-mutuel wagering and
breeding law, as added by chapter 174 of the laws of 2013, are amended
to read as follows:
The decision by the [board] STATE GAMING COMMISSION to select a gaming
facility license applicant shall be weighted by [seventy] FORTY-FIVE
percent based on economic activity and business development factors
including:
The decision by the [board] STATE GAMING COMMISSION to select a gaming
facility license applicant shall be weighted by [twenty] FORTY-FIVE
percent based on local impact and siting factors including:
S 3. Paragraphs (c) and (d) of subdivision 2 of section 1320 of the
racing, pari-mutuel wagering and breeding law are relettered paragraphs
(d) and (e) and a new paragraph (c) is added to read as follows:
(C) CONSIDERING THE PUBLIC OPPOSITION IN THE HOST AND NEARBY MUNICI-
PALITIES WHICH MAY BE DEMONSTRATED BY PUBLIC COMMENT RECEIVED BY THE
BOARD OR GAMING APPLICANT;
S 4. This act shall take effect immediately.
