AN  ACT  to  amend  the  public health law, in relation to extending the
  number of days within a twelve month period  a  facility  may  receive
  reimbursement for a reserved bed

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subparagraph (iii) of paragraph (b) of  subdivision  25  of
section  2808 of the public health law, as amended by section 34 of part
D of chapter 56 of the laws of 2012, is amended to read as follows:
  (iii) payment to a facility for reserved bed days provided  on  behalf
of  such person for non-hospitalization leaves of absence may not exceed
ten days in any twelve month period.   PROVIDED,  HOWEVER,  SHOULD  SUCH
PERSON'S  INDIVIDUAL CARE PLAN PROVIDE FOR THERAPEUTIC LEAVE, PAYMENT TO
A FACILITY FOR RESERVE BED DAYS ON BEHALF OF SUCH PERSON FOR  NON-HOSPI-
TALIZATION  LEAVES  MAY  NOT EXCEED TWENTY-FIVE DAYS IN ANY TWELVE MONTH
PERIOD.
  S 2. This act shall take effect immediately.
