AN ACT to amend the environmental conservation law, in relation to coor-
  dinating  the  transfer  of  municipal  solid waste at the Elm Freight
  Handlers Facility

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Legislative  findings  and  intent. The Legislature finds
that, based on the information provided by Omni  Recycling  of  Babylon,
New  York,  and  the  inspection of the permitted solid waste facilities
(which export baled solid waste in region  one)  by  the  department  of
environmental  conservation's  division  of  materials management staff,
there is currently an immediate threat to human health due to the  accu-
mulation  of municipal solid waste at several Suffolk county facilities,
constituting an emergency.
  The Legislature hereby  authorizes  the  transfer  of  wrapped  and/or
bagged  bales  of  municipal  solid waste that are initially loaded onto
flatbed tractor trailers at the facilities noted in this section, at the
rail track located in Suffolk and Nassau counties, and the city  of  New
York.    The  bales shall be lifted from the flatbed trailers and placed
into railroad cars that shall be fully enclosed after loading. The load-
ed and/or enclosed railroad cars shall then be transported  to  lawfully
operating  rail  serviced  landfills.  This section allows the temporary
transfer of bagged bales of municipal solid waste from flatbed  trailers
to  gondola  railcars  equipped  with hard lid covers, at waste transfer
facilities in Suffolk and Nassau counties and the city of New York.
  S 2. The environmental conservation law is amended  by  adding  a  new
section 27-0309 to read as follows:
S  27-0309.  COORDINATING THE TRANSFER OF WRAPPED AND/OR BAGGED BALES OF
             SOLID MUNICIPAL WASTE.

AN ACT to amend the environmental conservation law, in relation to coor-
  dinating the transfer of municipal solid waste in Suffolk  and  Nassau
  counties

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Legislative findings  and  intent.  The  Legislature  finds
that,  based  on  the information provided by the department of environ-

in Suffolk county.
  The  Legislature  hereby  authorizes  the  transfer  of wrapped and/or

             SOLID MUNICIPAL WASTE.

  A. "PERMITTEE" AND/OR "APPLICANT" MEANS WASTE VENDORS OPERATING WITHIN
THE CITY OF NEW YORK, SUFFOLK AND NASSAU COUNTIES; AND
