AN ACT to amend the penal law, in relation to increasing  the  scope  of
  assault  in  the second degree and aggravated harassment in the second
  degree to include offenses committed against school personnel

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Section 120.05 of the penal law is amended by adding a new
subdivision 3-c to read as follows:
  3-C. WITH INTENT TO CAUSE PHYSICAL INJURY TO A SCHOOL OFFICER,  ADMIN-
ISTRATOR,  TEACHER'S  AIDE,  STUDENT TEACHER OR TEACHER IN THE COURSE OF
SUCH SCHOOL OFFICER, ADMINISTRATOR, TEACHER'S AIDE, STUDENT  TEACHER  OR
TEACHER'S  EMPLOYMENT,  HE  OR SHE CAUSES PHYSICAL INJURY TO SUCH SCHOOL
OFFICER, ADMINISTRATOR, TEACHER'S AIDE, STUDENT TEACHER OR TEACHER; OR
  S 2. Section 240.30 of the penal law is amended by adding a new subdi-
vision 3-a to read as follows:
  3-A. STRIKES, SHOVES, KICKS OR OTHERWISE SUBJECTS  A  SCHOOL  OFFICER,
ADMINISTRATOR, TEACHER'S AIDE, STUDENT TEACHER OR TEACHER ENGAGED IN THE
COURSE  OF  HIS  OR  HER  EMPLOYMENT TO PHYSICAL CONTACT, OR ATTEMPTS OR
THREATENS TO DO THE SAME; OR
  S 3. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
