S T A T E O F N E W Y O R K ________________________________________________________________________ 3882 2015-2016 Regular Sessions I N A S S E M B L Y January 28, 2015 ___________ Introduced by M. of A. FITZPATRICK -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to prohibiting on campus residency as a requirement for scholarships, grants and awards offered by the state university of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 141 to read as follows: S 141. SCHOLARSHIPS, GRANTS AND AWARDS; CAMPUS RESIDENCY REQUIREMENT PROHIBITED. 1. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, NO SCHOLAR- SHIP, GRANT, AWARD OR ANY OTHER FORM OF TUITION ASSISTANCE OFFERED BY ANY COLLEGE OF THE UNIVERSITY, SHALL, AS A CONDITION OF ELIGIBILITY, REQUIRE THAT THE STUDENT RECEIVING SUCH SCHOLARSHIP, GRANT, AWARD OR ASSISTANCE RESIDE ON CAMPUS IN CAMPUS HOUSING, EXCEPT WHERE SUCH SCHOL- ARSHIP, GRANT, AWARD OR ASSISTANCE IS SPECIFICALLY DESIGNATED FOR ON-CAMPUS HOUSING OR BOARD. 2. NOTHING IN THIS SECTION SHALL BE CONSTRUED TO PROHIBIT ANY COLLEGE OF THE UNIVERSITY FROM REQUIRING THAT A STUDENT BE A RESIDENT OF THE STATE OF NEW YORK IN ORDER TO BE ELIGIBLE TO RECEIVE A SCHOLARSHIP, GRANT, AWARD OR ANY OTHER FORM OF TUITION ASSISTANCE.
