AN  ACT  to  amend  the  town law, in relation to prohibiting the use of
  certain solid waste products in the town of Marilla, Erie county

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  130  of  the town law is amended by adding a new
subdivision 8-a to read as follows:
  8-A. PROHIBITING CERTAIN SOLID WASTE IN  THE  TOWN  OF  MARILLA,  ERIE
COUNTY.  IN  THE TOWN OF MARILLA, IN THE COUNTY OF ERIE, PROHIBITING THE
USE OR APPLICATION OF SLUDGE OR SEWER SLUDGE AS DEFINED IN THIS SUBDIVI-
SION UPON ANY LANDS WITHIN SUCH TOWN OR ANY PORTION THEREOF,  WHEN  SUCH
USE WOULD AFFECT THE PUBLIC HEALTH. FOR THE PURPOSE OF THIS SUBDIVISION:
  (A)  "SLUDGE"  MEANS  ANY  SOLID, SEMI-SOLID OR LIQUID WASTE GENERATED
FROM A WASTEWATER TREATMENT PLANT, WATER SUPPLY TREATMENT PLANT  OR  AIR
POLLUTION CONTROL FACILITY; AND
  (B)  "SEWAGE  SLUDGE"  MEANS  THE  ACCUMULATED  SEMI-SOLIDS  OR SOLIDS
RESULTING FROM TREATMENT OF WASTEWATERS FROM PUBLICLY OR PRIVATELY OWNED
OR OPERATED SEWAGE TREATMENT PLANTS.
  S 2. This act shall take effect on the first of January next  succeed-
ing the date on which it shall have become a law.
