SIMANOWITZ -- read once and referred to the Committee on Insurance AN ACT to amend the insurance law, in relation to requiring notifica- tions to insured persons that an out-of-network physician or special- ist may be used in their procedure, test or surgery THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The insurance law is amended by adding a new section 3242 to read as follows: S 3242. NOTICE OF OUT-OF-NETWORK PHYSICIAN OR SPECIALIST. EVERY PERSON INSURED UNDER A POLICY OF ACCIDENT AND HEALTH INSURANCE DELIVERED OR ISSUED FOR DELIVERY SHALL BE ENTITLED TO NOTIFICATION PRIOR TO THEIR PROCEDURE, TEST OR SURGERY FROM THE PHYSICIAN OR SPECIALIST WHO MAY BE USED IN SUCH PROCEDURE, TEST OR SURGERY THAT SUCH PHYSICIAN'S OR SPECIALIST'S SERVICES SHALL NOT BE COVERED BY THEIR INSURANCE POLICY.
