LUPINACCI -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to instruction regarding organ donation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 804-e to read as follows: S 804-E. INSTRUCTION RELATED TO ORGAN DONATION. 1. THE COMMISSIONER SHALL MAKE MATERIALS PROVIDING INFORMATION ON ORGAN DONATION AVAILABLE TO ALL SECONDARY SCHOOL PUPILS ON THE DEPARTMENT WEBSITE. 2. THE COMMISSIONER, IN CONSULTATION WITH THE DEPARTMENT OF PUBLIC HEALTH, SHALL IDENTIFY OR DEVELOP MATERIALS FOR EDUCATORS REGARDING ORGAN DONATION WHICH MAY BE USED BY SCHOOL DISTRICTS AND BOARDS OF COOP- ERATIVE EDUCATION SERVICES, AT THEIR OPTION, TO EDUCATE STUDENTS AS THEY DEEM APPROPRIATE. SUCH EDUCATION MATERIALS SHALL INCLUDE, BUT NOT BE LIMITED TO, INFORMATION REGARDING THE AVERAGE NUMBER OF DONATED ORGANS NEEDED AND/OR DONATED EVERY YEAR, THE NUMBER OF FATALITIES THAT RESULT FROM A SHORTAGE OF DONATED ORGANS, INFORMATION REGARDING REASONS WHY A PATIENT MAY NEED AN ORGAN DONATION, AND INFORMATION REGARDING HOW A STUDENT MAY ELECT TO BECOME AN ORGAN DONOR. SUCH MATERIALS SHALL BE AVAILABLE ON THE INTERNET WEBSITE OF THE EDUCATION DEPARTMENT. THE WEBSITE OF THE OFFICE SHALL PROVIDE A HYPERLINK TO THE INTERNET PAGE OF THE EDUCATION DEPARTMENT THAT DISPLAYS SUCH MATERIALS. 3. INSTRUCTION REGARDING ORGAN DONATION MAY BE INCLUDED IN THE HEALTH EDUCATION PROVIDED TO THE SECONDARY SCHOOL PUPILS AND SHALL BE TAUGHT BY TEACHERS CERTIFIED IN HEALTH EDUCATION. RELATED COURSES IN THE SECONDARY SCHOOL CURRICULUM MAY BE TAUGHT IN A MANNER SUPPORTIVE OF HEALTH EDUCA- TION REGARDING ORGAN DONATION. 4. SCHOOL AUTHORITIES SHALL BE AUTHORIZED TO PROVIDE THE NEEDED FACIL- ITIES, TIME, AND PLACE FOR THE INSTRUCTION SET FORTH IN THIS SECTION AND EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
