AN ACT to amend the agriculture and markets law, in relation to labeling
  products free of genetically modified organisms

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The agriculture and markets law is amended by adding a  new
section 214-o to read as follows:
  S 214-O. LABELING OF FOOD PRODUCTS FREE OF GENETICALLY MODIFIED ORGAN-
ISMS. FOOD PRODUCTS THAT NEITHER CONTAIN IN WHOLE OR IN PART GENETICALLY
MODIFIED ORGANISMS SHALL BEAR ON A LABEL THE PHRASE "GMO FREE".
  FOR  THE  PURPOSE  OF  THIS SECTION, A "GENETICALLY MODIFIED ORGANISM"
SHALL MEAN ANY ORGANISM THAT POSSESSES A NOVEL  COMBINATION  OF  GENETIC
MATERIAL OBTAINED THROUGH THE USE OF MODERN BIOTECHNOLOGY.
  S  2.  This  act shall take effect on the ninetieth day after it shall
become a law.
