BLAKE -- read once and referred to the Committee on Children and Families AN ACT to amend the social services law, in relation to requiring child day care facilities to post a copy of the most recent inspection report THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 390-i of the social services law, as added by section 1 of part Q of chapter 56 of the laws of 2014, is amended to read as follows: S 390-i. Notice of inspection report. In every child day care program that is licensed or registered pursuant to section three hundred ninety of this title BY THE OFFICE OF CHILDREN AND FAMILY SERVICES, OR, PURSU- ANT TO ARTICLE FORTY-SEVEN OF THE NEW YORK CITY HEALTH CODE, THE DEPART- MENT OF HEALTH AND MENTAL HYGIENE OF THE CITY OF NEW YORK, the child day care provider shall post and maintain in a prominent place, a notice, to be provided by the office of children and family services OR SUCH DEPARTMENT OF HEALTH AND MENTAL HYGIENE, that shall state the date the most recent child care inspection occurred and provide information for parents and caregivers regarding how to obtain information from such office regarding the results of the inspection. If possible, the child day care provider shall also post such information on the child day care program's website. Such child day care programs shall post and maintain, in a prominent place, such program's most recent compliance history as shown on the office of children and family services OR DEPARTMENT OF HEALTH AND MENTAL HYGIENE OF THE CITY OF NEW YORK website. S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law. Provided, however, that effective immediately any rules and regulations necessary to imple- ment the provisions of this act on its effective date are authorized and directed to be completed on or before such date. The social services law is amended by adding a new section 390-j to read as follows: S 390-J. PERFORMANCE SUMMARY CARD IN A CITY HAVING A POPULATION OF ONE MILLION OR MORE. 1. DEFINITIONS. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) "CHILD CARE SERVICE" SHALL MEAN ANY PERSON WHO PROVIDES CHILD DAY CARE IN A CITY HAVING A POPULATION OF ONE MILLION OR MORE THAT IS REQUIRED TO OBTAIN A PERMIT TO OPERATE PURSUANT TO THE HEALTH CODE OF SUCH CITY. (B) "PERFORMANCE SUMMARY CARD" SHALL MEAN AN INDIVIDUALIZED PLACARD THAT SUMMARIZES THE HEALTH AND SAFETY INSPECTIONS OF A CHILD CARE SERVICE TO REFLECT ITS COMPLIANCE WITH APPLICABLE LAWS. THE PERFORMANCE SUMMARY CARD SHALL SUMMARIZE RECENT INSPECTION VIOLATIONS AND SUSPEN- SIONS AS REQUIRED BY RULES PROMULGATED BY THE DEPARTMENT ISSUING SUCH CARD. A PERFORMANCE SUMMARY CARD MAY ALSO INCLUDE ADDITIONAL INFORMATION SUCH AS THE CAPACITY OF THE CHILD CARE SERVICE, THE LENGTH OF TIME FOR WHICH SUCH CHILD CARE SERVICE HAS OPERATED, A COMPARISON OF THE CHILD EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
