AN ACT to amend the public lands law, in  relation  to  the  upkeep  and
  maintenance of certain state-owned land

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 5 of section 30-a of the public lands  law,  as
renumbered by chapter 785 of the laws of 1982, is renumbered subdivision
6 and a new subdivision 5 is added to read as follows:
  5.  THE  HEAD  OF ANY STATE AGENCY HAVING CUSTODY OR JURISDICTION OVER
FACILITIES OR STRUCTURES ON STATE-OWNED LAND THAT HAVE NOT BEEN  IN  USE
FOR  THIRTY  DAYS SHALL ENSURE THAT THE PROPERTY REMAINS SECURE AND THAT
REGULAR UPKEEP AND MAINTENANCE ARE PERFORMED. ANY COSTS  INCURRED  BY  A
MUNICIPALITY  OR TAXING DISTRICT FOR EMERGENCY SERVICES, SECURITY, MAIN-
TENANCE, OR UPKEEP OF SUCH PROPERTY SHALL BE REIMBURSED BY THE STATE.
  S 2. This act shall take effect immediately.
