AN  ACT to amend the penal law, in relation to recording acts of govern-
  mental administration

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. The penal law is amended by adding a new section 195.18 to
read as follows:
S 195.18 RECORDING ACTS OF GOVERNMENTAL ADMINISTRATION.
  THE FACT THAT A PERSON TAKES A PHOTOGRAPH OR MAKES AN AUDIO  OR  VIDEO
RECORDING  OF A POLICE OFFICER, PEACE OFFICER, MEDICAL EMERGENCY TECHNI-
CIAN OR PERSONNEL, FIREMAN OR OTHER PUBLIC SERVANT PERFORMING  AN  OFFI-
CIAL FUNCTION, WHILE THE POLICE OFFICER, PEACE OFFICER, MEDICAL EMERGEN-
CY  TECHNICIAN  OR  PERSONNEL,  FIREMAN  OR OTHER PUBLIC SERVANT IS IN A
PUBLIC PLACE OR THE PERSON TAKING THE PHOTOGRAPH OR MAKING THE RECORDING
IS IN A PLACE HE OR SHE HAS THE RIGHT TO BE, DOES NOT CONSTITUTE, IN AND
OF ITSELF, A VIOLATION OF THE PROVISIONS OF THIS TITLE.
  S 2. This act shall take effect on the thirtieth day  after  it  shall
have become a law.
