AN ACT to amend the public health law,in relation  to  requiring  forty-
  eight  hour  admittance at a hospital for persons treated for overdose
  of a controlled substance

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public health law is amended by adding a new section
2805-y to read as follows:
  S 2805-Y. MANDATORY HOSPITAL ADMITTANCE PERIOD FOR OVERDOSE TREATMENT.
ANY PERSON TREATED IN A HOSPITAL,  AS  DEFINED  BY  SUBDIVISION  ONE  OF
SECTION  TWENTY-EIGHT  HUNDRED ONE OF THIS ARTICLE, FOR HAVING OVERDOSED
ON A CONTROLLED SUBSTANCE, AS DEFINED BY  SUBDIVISION  FIVE  OF  SECTION
THIRTY-THREE HUNDRED TWO OF THIS CHAPTER, SHALL BE REQUIRED TO BE ADMIT-
TED  TO  SUCH  FACILITY  FOR AT LEAST A FORTY-EIGHT HOUR PERIOD PRIOR TO
RELEASE. A HEALTH CARE PRACTITIONER SHALL INFORM SUCH PERSON,  PRIOR  TO
THEIR  RELEASE,  OF THE RISKS OF OVERDOSE AND STRATEGIES TO AVOID FUTURE
INSTANCES OF OVERDOSE.
  S 2. This act shall take effect immediately.
