AN  ACT  to  amend  the labor law, in relation to a leave of absence for
  military spouses

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision 2 of section 202-i of the labor law, as added
by chapter 495 of the laws of 2006, is amended to read as follows:
  2. The spouse of a member of the armed forces of  the  United  States,
national  guard  or  reserves  who  has been deployed during a period of
military conflict[, to a combat theater or combat  zone  of  operations]
shall  be  allowed  up  to ten days unpaid leave by their employer. Such
leave shall only be used when such person's spouse is on leave from  the
armed  forces  of  the  United  States, national guard or reserves while
deployed during a period of military conflict [to a  combat  theater  or
combat zone of operations].
  S 2. This act shall take effect immediately.

AN ACT to amend the labor law, in relation to a  leave  of  absence  for
  military spouses

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 202-i of the labor law is amended by adding  a  new
subdivision 5 to read as follows:
  5.  THE  SPOUSE  OF A MEMBER OF THE ARMED FORCES OF THE UNITED STATES,
NATIONAL GUARD OR RESERVES WHO HAS BEEN DEPLOYED, SHALL BE ALLOWED UP TO
TEN DAYS UNPAID LEAVE BY THEIR EMPLOYER. SUCH LEAVE SHALL ONLY  BE  USED
WHEN  SUCH  PERSON'S  SPOUSE  IS  ON  LEAVE FROM THE ARMED FORCES OF THE
UNITED STATES, NATIONAL GUARD, OR RESERVES AFTER  HAVING  BEEN  DEPLOYED
FOR A PERIOD OF NO LESS THAN ONE HUNDRED TWENTY DAYS.
  S 2. This act shall take effect immediately.
