  sion  of  Human  Rights) -- read once and referred to the Committee on
  Governmental Operations

AN ACT to amend the executive law, in relation to clarifying in  certain
  provisions  of  law  that  reasonable accommodation to enable a person
  with a disability to use and enjoy a dwelling includes the use  of  an
  animal to alleviate the symptoms or effects of a disability

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subparagraph 2 of  paragraph  (d)  of  subdivision  2-a  of
section  296 of the executive law, as amended by chapter 196 of the laws
of 2010, is amended to read as follows:
  (2) To refuse to make reasonable accommodations  in  rules,  policies,
practices,  or  services,  when  such accommodations may be necessary to
afford a person with a disability equal opportunity to use and  enjoy  a
dwelling,  INCLUDING  THE USE OF AN ANIMAL AS A REASONABLE ACCOMMODATION
TO ALLEVIATE SYMPTOMS OR EFFECTS OF A DISABILITY, AND including  reason-
able modification to common use portions of the dwelling, or
  S  2.  Paragraph  2  of subdivision 18 of section 296 of the executive
law, as amended by chapter 196 of the laws of 2010, is amended  to  read
as follows:
  (2)  To  refuse  to make reasonable accommodations in rules, policies,
practices, or services, when such accommodations  may  be  necessary  to
afford  said person with a disability equal opportunity to use and enjoy
a dwelling, INCLUDING THE USE OF AN ANIMAL AS A REASONABLE ACCOMMODATION
TO ALLEVIATE SYMPTOMS OR EFFECTS OF A DISABILITY, AND including  reason-
able modification to common use portions of the dwelling, or
  S 3. This act shall take effect immediately.
