AN ACT to authorize and direct the commissioner of health to research
the availability of any test used to determine the presence of
synthetic marijuana and/or cannabinoids in a person's system
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Legislative findings and purpose. The legislature finds and
declares that synthetic marijuana and cannabinoids are leading to many
health problems in our state. Many young men and women are ending up in
the hospital acting extremely violent and confused, one of the symptoms
of these increasingly popular drugs. The lack of testing capabilities
has made it difficult to diagnose and treat those under the influence of
such drugs. Therefore, the commissioner of health and department of
health shall conduct a study on developing a test to determine the pres-
ence of synthetic marijuana and/or cannabinoids in a person's system.
S 2. The commissioner of health is hereby authorized and directed to
research the availability of any test used to determine the presence of
synthetic marijuana and/or cannabinoids in a person's system. Such
commissioner shall consult with any agency, medical personnel, or labo-
ratory he or she deems appropriate to conduct such study. If such
commissioner determines that no such test currently exists, he or she
shall further research the feasibility of creating such a test. Within
12 months from the effective date of this act, such commissioner shall
transmit the results of such research, along with any recommendations
for the use or development of any tests to the governor, the temporary
president of the senate, and the speaker of the assembly.
S 3. This act shall take effect immediately.
