BILL NUMBER:S3199 TITLE OF BILL: An act to amend the penal law, in relation to including machete within the definition of a deadly weapon SUMMARY OF PROVISIONS: Section 1 of the bill amends subdivision 12 of section 10.00 of the penal law, as amended by chapter 257 of the laws of 2008, by adding "machete" to the definition of "deadly weapon". Section 2 of the bill sets forth an immediate effective date. JUSTIFICATION: Despite the obvious serious injury that can be caused by the use of a "machete", such weapons have not been included in the penal law's definition of "deadly weapon". This oversight is surprising given the common knowledge that machetes have often been used as weapons and are actually defined as such in Webster's dictionary - "Machete - a large heavy knife used for cutting sugarcane and underbrush and as a weapon". This legislation makes the necessary correction to the penal law so that perpetrators who use a machete as a weapon will be charged accordingly.

Subdivision 12 of section 10.00 of the penal law, as amended by chapter 257 of the laws of 2008, is amended to read as follows: 12. "Deadly weapon" means any loaded weapon from which a shot, readily capable of producing death or other serious physical injury, may be discharged, or a switchblade knife, gravity knife, pilum ballistic knife, metal knuckle knife, dagger, MACHETE, billy, blackjack, plastic knuckles, or metal knuckles. BILL NUMBER: S3199B TITLE OF BILL : An act to amend the penal law, in relation to machetes SUMMARY OF PROVISIONS : Section 1 of the bill amends section 265.01(2) of the penal law related to criminal possession of a weapon in the fourth degree to include machetes within the list of items that when used with intent unlawfully against another person, shall be a criminal offense. Section 2 of the bill states that the Act shall take effect immediately. JUSTIFICATION : Machetes have often been used as weapons and are actually defined as such in Webster's dictionary - "Machete - a large heavy knife used for cutting sugarcane and underbrush and as a weapon".
