BILL NUMBER:S3771 TITLE OF BILL: An act to amend the penal law, in relation to establishing the offense of making a false statement in an internet privacy policy PURPOSE OR GENERAL IDEA OF BILL: a person is guilty of making a false statement in an internet privacy policy, when operating or controlling an internet website, online service, online application or mobile application. SUMMARY OF SPECIFIC PROVISIONS: relates to establishing the offense of making a false statement in an internet privacy policy JUSTIFICATION: he or she knowingly makes a false or misleading statement in the privacy policy for such website, online service or application. SANDERS -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to establishing the offense of making a false statement in an internet privacy policy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 190.57 to read as follows: S 190.57 MAKING A FALSE STATEMENT IN AN INTERNET PRIVACY POLICY. A PERSON IS GUILTY OF MAKING A FALSE STATEMENT IN AN INTERNET PRIVACY POLICY, WHEN OPERATING OR CONTROLLING AN INTERNET WEBSITE, ONLINE SERVICE, ONLINE APPLICATION OR MOBILE APPLICATION, HE OR SHE KNOWINGLY MAKES A FALSE OR MISLEADING STATEMENT IN THE PRIVACY POLICY FOR SUCH WEBSITE, ONLINE SERVICE OR APPLICATION. MAKING A FALSE STATEMENT IN AN INTERNET PRIVACY POLICY IS A CLASS A MISDEMEANOR. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
