AN ACT to amend the public health law, in relation to membership of the
advisory council established within the acquired immune deficiency
syndrome institute
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 1 of section 2778 of the public health law, as
amended by chapter 172 of the laws of 1990, is amended to read as
follows:
1. There shall be established within the institute an advisory council
composed of seventeen members who shall be appointed in the following
manner: three shall be appointed by the temporary president of the
senate and one by the minority leader of the senate; three shall be
appointed by the speaker of the assembly and one by the minority leader
of the assembly; nine shall be appointed by the governor. The governor
shall designate the chairman of the advisory council. THE MEMBERS SHALL
BE APPOINTED FOR A TERM OF FOUR YEARS, AND MAY BE RE-APPOINTED FOR ONE
ADDITIONAL TERM OF FOUR YEARS. IN NO CASE SHALL ANY MEMBER SERVE MORE
THAN A TOTAL OF EIGHT YEARS. VACANCIES SHALL BE FILLED IN THE MANNER OF
ORIGINAL APPOINTMENTS FOR THE REMAINDER OF THE TERM. THE MEMBERS SHALL
BE REPRESENTATIVE OF THE INFECTED POPULATION WITH HIV/AIDS IN THE STATE
OF NEW YORK BASED ON CENTERS FOR DISEASE CONTROL AND PREVENTION (CDC)
STATISTICS INCLUDING RACE, ETHNICITY, AND GENDER. THE COUNCIL SHALL
INCLUDE AT LEAST SIX MEMBERS INFECTED WITH HIV/AIDS. The members of the
council shall ALSO be representative of the public, educational and
medical institutions, local health departments and nonprofit organiza-
tions, including organizations providing services to high risk popu-
lations.
S 2. This act shall take effect one year after it shall have become a
law.
