  printed to be committed to the Committee on  Energy  and  Telecommuni-
  cations

AN  ACT  to  amend the public service law, in relation to establishing a
  natural gas safety and  infrastructure  replacement  program;  and  to
  amend the state finance law, in relation to establishing a natural gas
  safety and infrastructure replacement fund

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public service law is amended by adding a  new  section
74 to read as follows:
  S  74.  NATURAL GAS SAFETY AND INFRASTRUCTURE REPLACEMENT PROGRAM.  1.
WITHIN AMOUNTS APPROPRIATED THEREFOR, THE  DIRECTOR  OF  THE  BUDGET  IS
HEREBY  AUTHORIZED TO APPROVE FUNDING TO PROMOTE THE REPLACEMENT OF BARE
STEEL PIPE AND CAST IRON PIPE USED  FOR  NATURAL  GAS  DISTRIBUTION  AND
TRANSMISSION SYSTEMS AS PROVIDED FOR IN THIS SECTION.
  2.  THE DIRECTOR OF THE BUDGET IS HEREBY AUTHORIZED TO APPROVE FUNDING
FOR THE RELOCATION, RESTORATION, AND PROTECTION OF MUNICIPAL UNDERGROUND
INFRASTRUCTURE IN CONNECTION WITH THE REPLACEMENT OF BARE STEEL PIPE  OR
CAST  IRON  PIPE  USED  FOR  NATURAL  GAS  DISTRIBUTION AND TRANSMISSION
SYSTEMS APPROVED BY THE COMMISSION. SUCH FUNDING SHALL INCLUDE  BUT  NOT
BE  LIMITED TO FINANCIAL ASSISTANCE TO MUNICIPALITIES TO DIRECTLY OFFSET
ANY COSTS RELATED  TO  MOVING,  RECONFIGURING,  MODIFYING,  RESTORATION,
PAVING AND SUPPORTING MUNICIPAL UNDERGROUND INFRASTRUCTURE IN CONNECTION
WITH THE REPLACEMENT OF BARE STEEL PIPE OR CAST IRON PIPE.
  3.  THE DIRECTOR OF THE BUDGET IS AUTHORIZED TO ESTABLISH A PROGRAM OF
FINANCIAL ASSISTANCE IN THE FORM OF GRANTS TO  MUNICIPALITIES  FOR  SUCH
RELOCATION  AND  PROTECTION OF MUNICIPAL UNDERGROUND INFRASTRUCTURE WORK
IN CONSULTATION WITH THE DEPARTMENT OF PUBLIC SERVICE.
  S 2. The state finance law is amended by adding a new section 89-i  to
read as follows:
