BILL NUMBER:S5208 TITLE OF BILL: An act to amend the education law, in relation to allowing physician assistants to partner with physicians PURPOSE: To clarify that physicians and physician assistants may partner and form entities under the business corporation law. SUMMARY OF PROVISIONS: Section one amends section 6542 of the edudation law to clarify that physicians and physician assistants may partner and form professional entities. It does not alter the requirement that physician assistants operate with physician supervision. Section five provides for the effective date. EXISTING LAW: Current law does not specifically prevent physicians and physician assistants from partnering to own a business such as a medical clinic, however, the State Department of Health has not allowed such arrangements. This bill would clarify that the law does not preclude physicians and physician assistants from forming such professional

RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to allowing physician assistants to partner with physicians THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 6542 of the education law is amended by adding a new subdivision 8 to read as follows: 8. NOTHING IN THIS ARTICLE SHALL PROHIBIT A PHYSICIAN ASSISTANT FROM ESTABLISHING A PROFESSIONAL ENTITY WITH ONE OR MORE PHYSICIANS PURSUANT TO SECTION FIFTEEN HUNDRED ONE OF THE BUSINESS CORPORATION LAW. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10822-01-5
