  printed to be committed to the Committee on  Energy  and  Telecommuni-
  cations

AN  ACT  to  amend  the public authorities law, in relation to the green
  jobs-green New York revolving loan fund

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subparagraph  (iv)  of  paragraph (c) of subdivision 1 of
section 1896 of the public authorities law, as amended by chapter 388 of
the laws of 2011, is amended to read as follows:
  (iv) establish standards for customer participation  in  such  on-bill
recovery  mechanism,  including  standards  for  reliable  utility  bill
payment, current good standing on any  mortgage  obligations,  and  such
additional  standards as the authority deems necessary; provided that in
order to provide broad access to on-bill recovery, the authority  shall,
to  the  fullest  extent  practicable,  consider alternative measures of
creditworthiness that are prudent in order to include  participation  by
customers  who  are less likely to have access to traditional sources of
financing. STANDARDS FOR CUSTOMER PARTICIPATION MAY NOT HOWEVER  INCLUDE
A  DETERMINATION OF A CUSTOMER'S CREDITWORTHINESS BUT SHOULD BE BASED ON
THE CUSTOMER'S PAST UTILITY BILL PAYMENT HISTORY;
  S 2. Subdivisions 3 and 4 of section 1893 of  the  public  authorities
law,  as added by chapter 487 of the laws of 2009, are amended and a new
subdivision 5 is added to read as follows:
  3. enter into contracts with  one  or  more  program  implementers  to
perform such functions as the authority deems appropriate; [and]
  4. exercise such other powers as are necessary for the proper adminis-
tration of the program[.]; AND
  5.  DISTRIBUTE  THE  FUNDS SO THAT THIRTY-TWO PERCENT OF THE FUNDS ARE
ALLOCATED TO NEW YORK CITY AND SIXTY-TWO PERCENT  TO  THE  REST  OF  THE
STATE.
