BILL NUMBER:S5707 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to farm brewery licensees PURPOSE: To authorize farm breweries to sell wine and spirits manufactured by a licensed farm winery or distillery. SUMMARY OF PROVISIONS: Section 1 amends § 51-a(2)(e) of the alcoholic beverage control law to permit farm breweries to sell wine and spirits manufactured by any licensed farm winery or distiller at retail for consumption on or off a farm brewery's premises. Section 2 provides the effective date. EXISTING LAW: § 51-a of the Alcoholic Beverage Control Law authorizes the operation of licensed farm breweries. The section provides that any person may apply to the State Liquor Authority (SLA) for a farm brewery license

Paragraph (e) of subdivision 2 of section 51-a of the alco- holic beverage control law, as added by chapter 108 of the laws of 2012, is amended to read as follows: (e) sell at the licensed premises beer and cider manufactured by the licensee or any other licensed farm brewery, AND WINE AND SPIRITS MANU- FACTURED BY ANY LICENSED FARM WINERY OR DISTILLERY, at retail for consumption on or off the licensed premises; S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11316-01-5
