2015-S5763 (ACTIVE) - Summary
Provides that for the purposes of state and local financing, the term thereof shall be 25 years for class B buildings, 20 years for class C buildings and 40 years for class D buildings; defines class D buildings as buildings which have a reference service life of at least 60 years, or are constructed of materials selected using the green building construction requirements; expands the definition of class B buildings to include buildings having outer walls constructed of fire-resistant treated wood.

BILL NUMBER:S5763 TITLE OF BILL: An act to amend the state finance law, in relation to the probable life of class B, class C, and class D buildings; and to amend the local finance law, in relation to the periods of probable usefulness of class B, class C, and class D buildings PURPOSE: Provides that the probably life of certain works and period of probably usefulness be 25 years for Class B buildings, 20 years for Class C buildings and 40 years for Class D Buildings. SUMMARY OF PROVISIONS: Section 1. Amends subdivisions 2 and 3 of section 61 of the state finance law and adds a new subdivision 3-a. Section 2: Amends clauses (b) and (c) of subdivision 11 of paragraph a of section 11.00 of local finance law and a new clause (d) is added. Section 3: Sets the effective date. JUSTIFICATION: Currently in state finance law and local finance law, the distinction between building construction types includes an antiquated definition, and does not align with current provisions of the state's building codes as the useful life of a building is no longer related to the type of construction. AMEDORE -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the state finance law, in relation to the probable life of class B, class C, and class D buildings; and to amend the local finance law, in relation to the periods of probable usefulness of class B, class C, and class D buildings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 2 and 3 of section 61 of the state finance law are amended and a new subdivision 3-a is added to read as follows: 2. [Twenty] TWENTY-FIVE years. Class B buildings. Buildings, the outer walls of which are constructed of brick, stone, concrete, metal, stucco, FIRE-RESISTANT TREATED WOOD or other fire-resisting material, including a building which is rebuilt or altered so that it, together with addi- tions or vertical or other extensions or replacements, are fire-resist- ing. 3. [Fifteen] TWENTY years. Class C buildings. Buildings that are neither class A nor class B as defined in subdivisions one and two, including any such building which is rebuilt or altered so that any addition or vertical or other extension is not fire-proof or fire-re- sisting, as thus defined. 3-A. FORTY YEARS. CLASS D BUILDINGS. BUILDINGS FOR WHICH A LIFE CYCLE ASSESSMENT HAS BEEN PERFORMED AS PART OF THE DESIGN PROCESS AND WHICH HAVE A REFERENCE SERVICE LIFE OF AT LEAST SIXTY YEARS, OR BUILDINGS FOR WHICH THE STRUCTURAL MATERIALS WERE SELECTED USING THE GREEN BUILDING CONSTRUCTION REQUIREMENTS ESTABLISHED PURSUANT TO ARTICLE FOUR-C OF THE PUBLIC BUILDINGS LAW. S 2.
