BILL NUMBER:S5922 TITLE OF BILL: An act in relation to the management and conservation of horseshoe crabs; and providing for the repeal of such provisions upon expiration thereof PURPOSE: To require the Department of Environmental Conservation (DEC) to consider certain conservation criteria when managing horseshoe crabs. SUMMARY OF PROVISIONS: This bill would require the DEC, in its management plan of horseshoe crabs, to consider certain criteria. JUSTIFICATION: The horseshoe crab has sometimes been called a living fossil, having remained relatively unchanged in appearance for 350 million years. Horseshoe crabs are an important part of the ecosystem, serving as a food source for migratory shorebirds, including red knots, functioning as bait for the taking of whelk and American eel and providing an important contribution to medicine with a clotting agent in their blood called Limulus Amoebocyte Lysate (LAL) for which there is currently no synthetic substitute. This legislation recognizes the importance of horseshoe crabs and requires DEC to examine certain conservation and management issues. LEGISLATIVE HISTORY: New bill.

ENGLEBRIGHT -- read once and referred to the Committee on Governmental Operations AN ACT in relation to the management and conservation of horseshoe crabs; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. As part of the management and conservation measures author- ized under subdivision 7 of section 13-0331 of the environmental conser- vation law as pertains to horseshoe crabs, the department of environ- mental conservation shall consider the following: (a) the use of bait bags in whelk pots; (b) the impacts of establishing seasons during spawning and nonspawn- ing seasons; (c) the impacts of establishing harvest limits based on sex; and (d) ecologically based consideration of harvest limits and quotas to include factors such as shore bird consumption based on information collected and used by the Atlantic States Marine Fishery Commission. S 2. This act shall take effect immediately and shall expire and be deemed repealed December 31, 2017.
