BILL NUMBER:S6034 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to tinting on motor vehicle windows PURPOSE: To add rear windows to current tinted or shaded window statutes. SUMMARY OF PROVISIONS: Section 1 - Amends paragraph (b) of subdivision 12-a of section 375 of the vehicle and traffic law, as amended by chapter 155 of the laws 1991. Section 2 - Effective date JUSTIFICATION: Glass that is too dark inhibits drivers from making the necessary observations to understand the intent of another driver. It also hampers law enforcement's ability to observe if illegal activity is occurring within the vehicle. Current law sets a 70% light transmittance requirement for front windows. DeFRANCISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the vehicle and traffic law, in relation to tinting on motor vehicle windows THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 12-a of section 375 of the vehicle and traffic law, as amended by chapter 155 of the laws of 1991, is amended to read as follows: (b) No person shall operate any motor vehicle upon any public highway, road or street: (1) the front windshield of which is composed of, covered by or treat- ed with any material which has a light transmittance of less than seven- ty percent unless such materials are limited to the uppermost six inches of the windshield; or (2) the sidewings or side windows of which on either side forward of or adjacent to the operator's seat are composed of, covered by or treat- ed with any material which has a light transmittance of less than seven- ty percent; or (3) [if it is classified as a station wagon, sedan, hardtop, coupe, hatchback or convertible and any] THE rear side [window] WINDOWS OF WHICH ARE COMPOSED OF, COVERED BY, OR TREATED WITH ANY MATERIAL WHICH has a light transmittance of less than seventy percent; or (4) the rear window of which is composed of, covered by or treated with any material which has a light transmittance of less than seventy percent. [A rear window may have a light transmittance of less than seventy percent if the vehicle is equipped with side mirrors on both sides of the vehicle so adjusted that the driver thereof shall have a clear and full view of the road and condition of traffic behind such vehicle.] EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. BILL NUMBER: S6034A TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to including the examination of tinted or shaded windows in the periodic inspection of motor vehicles PURPOSE OR GENERAL IDEA OF BILL : To include an examination of window tint in the yearly state inspection of a vehicle. SUMMARY OF SPECIFIC PROVISIONS : Section 1 -- Amends subparagraph (a) of paragraph 1 of subdivision (c) section 301 of the Vehicle and Traffic Law to require tinted glass to be one of the items inspected during the yearly New York State inspection of a vehicle. JUSTIFICATION : Many vehicle owners do not realize the windows on their vehicles are tinted darker than New York State law currently permits. In order to take a more proactive approach in regulating this problem, and enforcing current law, this bill would include tinted glass to be one

DeFRANCISCO, ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Rules -- recom- mitted to the Committee on Transportation in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the vehicle and traffic law, in relation to including the examination of tinted or shaded windows in the periodic inspection of motor vehicles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (a) of paragraph 1 of subdivision (c) of section 301 of the vehicle and traffic law, as amended by section 5 of part V1 of chapter 62 of the laws of 2003, is amended to read as follows: (a) A safety inspection shall be made with respect to the brakes; steering mechanism; wheel alignment; lights, including but not limited to the lights which are designed and placed on a vehicle for the purpose of illuminating the vehicle's license plates; odometer; tire pressure; seat safety belts; shoulder harness safety belts; ANY WINDOW WHICH IS COMPOSED OF, COVERED BY OR TREATED WITH ANY MATERIAL WHICH HAS A LIGHT TRANSMITTANCE OF LESS THAN SEVENTY PERCENT PURSUANT TO SECTION THREE HUNDRED SEVENTY-FIVE OF THIS TITLE and such other mechanisms and equip- ment as shall be determined by the commissioner to be necessary for proper and safe operations. Such inspection shall also be made with respect to vehicle identification number. Upon inspection, the mileage appearing on the odometer shall be recorded upon the inspection sticker. S 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law; provided that the commissioner of motor vehicles is authorized to promulgate any and all rules and regulations necessary and take any other measures necessary to implement this act on its effective date on or before such date.
