BILL NUMBER: S6320 TITLE OF BILL : An act to amend the education law, in relation to aid to school districts educating Native American pupils PURPOSE : To ensure prompt payment of aid to school districts providing education to Native American students SUMMARY OF PROVISIONS : Section 1 - amends paragraph b of subdivision 2 of section 4115 of the Education Law to provide that for all years commencing July 1st, 2016 all amounts required to be paid pursuant to subdivision 4115 shall be made within 180 days of the date the number of Native American pupils educated by the district is determined. Section 2 - provides the effective date. JUSTIFICATION : There are many school districts across New York State educating Native American students that receive payment under the provisions of Education Law section 4115. Unfortunately, these districts have faced long and unexplained delays in receiving the payments that they are owed under these provisions. These districts provide education services, and are entitled to timely payment for the services provided. School districts rely on this funding when developing their budgets, and the long delays in payments, which can be in the millions of dollars, put unnecessary financial strains on district budgets and finances.
