BILL NUMBER: S6727 TITLE OF BILL : An act to amend the penal law, in relation to the commission of larceny PURPOSE : This bill amends Section 155.05 of the Penal Law to define a crime of larceny as including the aggregate amount of property stolen by a person in a common scheme to defraud SUMMARY OF PROVISIONS : Section 1 amends Subdivision 1 of Section 155.05 of the Penal Law to define larceny as including the aggregate amount of property illegally appropriated to oneself, or a third party, in a common scheme to defraud Section 2 amends Subdivision 2 of Section 155.20 of the Penal Law to define the "value" of property involved in a larceny to include the aggregate market value of all the property taken, obtained, or withheld during a common scheme to defraud Section 3 sets forth the effective date of the law. PERALTA -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to the commission of larceny THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 155.05 of the penal law is amended to read as follows: 1. A person steals property and commits larceny when, with intent to deprive another PERSON of property or to appropriate the same to himself OR HERSELF, or to a third person, he OR SHE ON ONE OR MORE OCCASIONS OR THROUGH ONE OR MORE TRANSACTIONS, WHICH CONSTITUTE A COMMON SCHEME, wrongfully takes, obtains or withholds such property from an owner ther- eof. S 2. Subdivision 1 of section 155.20 of the penal law is amended to read as follows: 1. Except as otherwise specified in this section, value means the AGGREGATE market value of ALL the property TAKEN, OBTAINED OR WITHHELD, DURING A COMMON SCHEME, at the [time] TIMES and [place] PLACES of the crime, or if such cannot be satisfactorily ascertained, the cost of replacement of [the] SUCH property within a reasonable time after the crime. S 3. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
