BILL NUMBER: S7158 REVISED MEMO 04/04/2016 TITLE OF BILL : An act to amend the tax law, in relation to the farm workforce retention credit PURPOSE : To amend the farm workforce retention credit as proposed in legislative bill numbers S6409-C and A.9009-C by providing separate tax credits for the Counties of Nassau and Suffolk. SUMMARY OF PROVISIONS : Section 1. Provides for a new subdivision e-1 of section 42 of the tax law by establishing monetary amounts for credits for tax years 2017 through 2021. Section 2. Amends the proposed subdivision (e) of section 42 of the tax law by correcting the monetary amounts for tax years 2019 and 2020. JUSTIFICATION : The proposed Farm Workforce Retention Act is aimed at providing relief to farmers who are incurring increased expenses through wage escalation for the next five years. Section 42 of the tax law, as added by section 1 of part RR of a chapter of the laws of 2016, amending the tax law relating to creating the farm workforce retention credit, as proposed in legislative bill numbers S. 6409-C and A. 9009-C, is amended by adding a new subdi- vision (e-1) to read as follows: (E-1) FOR TAXABLE YEARS BEGINNING ON OR AFTER JANUARY FIRST, TWO THOU- SAND SEVENTEEN AND BEFORE JANUARY FIRST, TWO THOUSAND EIGHTEEN, IF SUCH FARM IS LOCATED IN NASSAU OR SUFFOLK COUNTY, THE AMOUNT OF THE CREDIT ALLOWED UNDER THIS SECTION SHALL BE EQUAL TO THE PRODUCT OF THE TOTAL NUMBER OF ELIGIBLE FARM EMPLOYEES AND FIVE HUNDRED DOLLARS. FOR TAXABLE YEARS BEGINNING ON OR AFTER JANUARY FIRST, TWO THOUSAND EIGHTEEN AND BEFORE JANUARY FIRST, TWO THOUSAND NINETEEN, IF SUCH FARM IS LOCATED IN NASSAU OR SUFFOLK COUNTY, THE AMOUNT OF THE CREDIT ALLOWED UNDER THIS SECTION SHALL BE EQUAL TO THE PRODUCT OF THE TOTAL NUMBER OF ELIGIBLE FARM EMPLOYEES AND SIX HUNDRED DOLLARS. The present legislation provides for a state wide credit system. Due to the fact that the counties of Nassau and Suffolk will have greater wage costs, a single statewide credit is inequitable. This bill will give Long Island farmers a fair credit.
