                                 BILL NUMBER:  S7242

 TITLE OF BILL :  An act to amend the education law, in relation to
registered pharmacy interns

 PURPOSE OR GENERAL IDEA OF BILL :

Authorizes trained registered pharmacy interns to administer
immunization injections under the supervision of a licensed
pharmacist.

 SUMMARY OF SPECIFIC PROVISIONS :

Section 1 amends subdivision 2 and subdivision 3 of section 6801 of
the education law to authorize a registered pharmacy intern to
administer immunization injections.

Section 2 adds a new subdivision 5 to section 6801 of the education
law to require that any licensed pharmacy intern administering an
injection only do so under the supervision of a licensed pharmacist.

Section 3 contains the effective date.

 JUSTIFICATION :

New York is one of the few states which do not authorize registered

pharmacy interns to administer immunization injections. As of 2012, 35
states allowed such administration.

New York's pharmacy colleges are losing students to out of state
rotation programs due to the current state law. Normally, pharmacy
students participate in a rotation internship during the latter half
of their degree program. Without the ability to administer injections,
these students are denied the experience of administering an
injection. Instead, they must wait until they have already entered the
work force to learn how this essential skill in an applied setting.

This bill corrects this by authorizing registered pharmacies interns
to administer injections while under the direct supervisions of a
registered pharmacist. Students would have to attain a specific
certification or complete equivalent coursework before they were able
to administer such injections. This would provide a valuable learning
experience to pharmacy students while maintaining oversight.

 PRIOR LEGISLATIVE HISTORY :

None to the state.

 EFFECTIVE DATE :
This act shall take effect immediately; provided, however, that the
amendments made to section 6801 of the education law by section one of
this act shall not affect the expiration of such section and shall be
deemed expired therewith.

AN ACT to amend the education law, in relation  to  registered  pharmacy
  interns

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The opening paragraph of subdivision 2 and subdivision 3 of
section 6801 of the education law, the opening paragraph of  subdivision
2  as  amended  by  chapter  46 of the laws of 2015 and subdivision 3 as
added by chapter 563 of the laws of 2008, are amended and a new subdivi-
sion 5 is added to read as follows:
  A licensed pharmacist OR A REGISTERED PHARMACY INTERN  may  execute  a
non-patient  specific  regimen  prescribed  or  ordered  by  a physician
licensed in this state or nurse practitioner certified  in  this  state,
pursuant  to rules and regulations promulgated by the commissioner. When
a licensed pharmacist administers an immunizing agent, he or she shall:
  3. No pharmacist OR REGISTERED PHARMACY INTERN shall administer immun-
izing agents without receiving training satisfactory to the commissioner
and the commissioner of health which shall include, but not  be  limited
to, techniques for screening individuals and obtaining informed consent;
techniques of administration; indications, precautions and contraindica-
tions  in the use of agent or agents; record keeping of immunization and
information; and handling emergencies, including anaphylaxis  and  need-
lesticks.
  5. IN THE CASE OF A REGISTERED PHARMACY INTERN, ADMINISTRATION MUST BE
CONDUCTED  IN  THE PHYSICAL PRESENCE OF A LICENSED PHARMACIST AUTHORIZED
TO ADMINISTER VACCINES.
  S 2. This act shall take effect immediately; provided,  however,  that
the amendments made to section 6801 of the education law made by section
one  of  this  act  shall  not affect the expiration of such section and
shall be deemed expired therewith.
