BILL NUMBER: S7306 TITLE OF BILL : An act to amend the public health law, in relation to removing {123l} loflupane from the designation as a controlled substance PURPOSE : To conform New York State statute to the federal controlled substance act by exempting ioflupane. SUMMARY OF PROVISIONS : Section one of the bill removes {1231} ioflupane from the controlled substance schedules. Section two of the bill is the effective date. JUSTIFICATION : {1231} ioflupane, the active ingredient in DaTscan, is an FDA-approved radiopharmaceutical visual imaging agent that is used to help medical practitioners differentiate between Parkinsonian syndromes and essential tremors by allowing practitioners to capture detailed pictures of the dopamine receptors in the brain.

HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to removing {123l} loflupane from the designation as a controlled substance THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph 4 of subdivision (b) of schedule II of section 3306 of the public health law, as added by chapter 664 of the laws of 1985, is amended to read as follows: (4) Coca leaves and any salt, compound, derivative, or preparation of coca leaves, and any salt, compound, derivative, or preparation thereof which is chemically equivalent or identical with any of these substances including cocaine and ecgonine, their salts, isomers, and salts of isom- ers, except that the substances shall not include decocainized coca leaves or extraction of coca leaves, which extractions do not contain cocaine [or], ecgonine OR {123L} IOFLUPANE. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15006-01-6
