  printed to be committed to the Committee on Transportation

AN ACT to amend the vehicle and traffic law, in relation to the issuance
  of a new driver's license to identify theft victims

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 505 of the vehicle and traffic law  is  amended  by
adding a new subdivision 7 to read as follows:
  7.  IDENTITY THEFT. A LICENSEE OR APPLICANT WHO HAS BEEN THE VICTIM OF
IDENTITY THEFT ARISING FROM  THEFT  OF  THE  LICENSEE'S  OR  APPLICANT'S
LICENSE  MAY APPLY TO THE DEPARTMENT FOR A NEW LICENSE. THE COMMISSIONER
SHALL REQUIRE SUCH PERSON TO SUBMIT PROOF ACCEPTABLE TO HIM OR HER  WITH
RESPECT TO THE FACTS, AND UPON APPROVAL OF SUCH PROOF, AND THE SURRENDER
OF  THE PRIOR LICENSE IF SUCH LICENSE IS IN THE POSSESSION OF THE APPLI-
CANT, THE COMMISSIONER SHALL ISSUE A NEW LICENSE AT NO FEE.  THE COMMIS-
SIONER SHALL PROMULGATE ALL NECESSARY OR DESIRABLE RULES AND REGULATIONS
TO  IMPLEMENT  THE  PROVISIONS  OF  THIS  SUBDIVISION,  INCLUDING  THOSE
PERTAINING TO WHAT PROOF OF THE FACTS IS SUFFICIENT TO ESTABLISH IDENTI-
TY THEFT.
  S 2. This act shall take effect immediately.
