BILL NUMBER: S7364 TITLE OF BILL : An act to authorize the city of Binghamton to classify certain cooperative apartments as homestead properties PURPOSE : This bill will allow the City of Binghamton to change the designation of two cooperative apartments from non-homestead to homestead properties. SUMMARY OF PROVISIONS : Section 1 of the bill would amend the real property tax law by authorizing the Assessor of the City of Binghamton to transfer two properties in the City from the non-homestead tax levy to the homestead tax levy. Section 2 is the effective date. JUSTIFICATION : In 1993, the City of Binghamton adopted a local law adopting the provisions of the Real Property Tax Law, section 1903, concerning homestead base proportions. AKSHAR -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize the city of Binghamton to classify certain cooper- ative apartments as homestead properties THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the assessor of the city of Binghamton is hereby authorized to transfer properties consisting of cooperative apartments located at 5 Riverside Drive and 4 Oak Street in the city of Binghamton, county of Broome, from the non-homestead tax levy to the homestead tax levy pursuant to section 581 of the real property tax law. The transfer authorized pursuant to this section shall apply solely for levy purposes and no alteration of the property class or assessment value of such properties shall result from the transfer. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14960-01-6
