BILL NUMBER: S7378 TITLE OF BILL : An act to amend the workers' compensation law, in relation to the definition of "employer" for the purposes of disability benefits PURPOSE : For the purpose of disability benefits, this bill would amend the definition of "employer". SUMMARY OF SPECIFIC PROVISIONS : Section 1 - Amends subdivision 4 of section 201 of the workers' compensation law, as added by chapter 600 of the laws of 1949. Section 2 - Effective date JUSTIFICATION : There are a unique set of factors which make Small businesses more vulnerable and disproportionately impacted by economic changes. This is why half of all small businesses (identified as those with 50 employees or less) do not survive beyond two years. This is the sound reasoning behind why small businesses are often times exempted from initiatives which would have less of an impact on larger businesses.

DeFRANCISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the workers' compensation law, in relation to the defi- nition of "employer" for the purposes of disability benefits THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 201 of the workers' compensation law, as added by chapter 600 of the laws of 1949, is amended to read as follows: 4. "Employer," except when otherwise expressly stated, means a person, partnership, association, corporation, legal representative of a deceased employer, or the receiver or trustee of a person, partnership, association or corporation, who has persons in employment as defined in subdivision six of this section AND WHO HAS FIFTY OR MORE EMPLOYEES, but does not include the state, a municipal corporation, local governmental agency, other political subdivisions or public authority. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15104-01-6
