BILL NUMBER: S7452 TITLE OF BILL : An act to amend the public health law, in relation to safe patient handling in schools operated by the office for people with developmental disabilities PURPOSE OR GENERAL IDEA OF BILL : This legislation seeks to clarify that the Safe Patient Handling Act intended to cover developmental centers and not home or day habilitation programs. SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends Subdivision 1 of section 2997-h of the public health law to change the definition of health care facility as it relates to mental hygiene law. Section 2 is the effective date. JUSTIFICATION : The intent of the Safe Patient handling program was to include only developmental centers which are significantly larger than day programs.While MHL 1.03 contains relevant information it also may be interpreted too broadly could catch intermediate care facilities, day habilitation programs, or individuals homes. By using MHL 15.03 we would clarify the intent of this act to cover developmental centers

ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to safe patient handling in schools operated by the office for people with develop- mental disabilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 2997-h of the public health law, as added by section 20 of part A of chapter 60 of the laws of 2014, is amended to read as follows: 1. "Health care facility" shall mean general hospitals, residential health care facilities, diagnostic and treatment centers, and clinics licensed pursuant to article twenty-eight of this chapter, facilities which provide health care services and are licensed or operated pursuant to article eight of the education law, article nineteen-G of the execu- tive law or the correction law, and [hospitals and] schools [defined] AS SET FORTH in section [1.03] 15.03 of the mental hygiene law. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15067-01-6
