BILL NUMBER: S7465 TITLE OF BILL : An act to amend the executive law, in relation to authorizing certain transfers of public employees in the unclassified service PURPOSE OF THE BILL : To facilitate the transfer of certain employees in the unclassified service to the Business Services Center ("BSC"), this bill would authorize the transfer of such employees to the Office of General Services ("OGS"). SUMMARY OF PROVISIONS : This bill would amend the Executive Law to authorize the transfer of certain employees in the unclassified service to OGS in conjunction with the transfer of an agency's financial and human resources functions to the BSC. JUSTIFICATION : The BSC was established as a business unit of OGS in 2012 to provide for shared services to standardize human resources and financial transactions for executive State agencies. GOLDEN -- (at request of the Office of General Services) -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the executive law, in relation to authorizing certain transfers of public employees in the unclassified service THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 204 to read as follows: S 204. CERTAIN TRANSFERS OF PUBLIC EMPLOYEES IN THE UNCLASSIFIED SERVICE. EMPLOYEES IN THE UNCLASSIFIED SERVICE OF THE STATE, WHO ARE SUBSTANTIALLY ENGAGED IN THE PERFORMANCE OF DUTIES TO SUPPORT BUSINESS AND FINANCIAL SERVICES, ADMINISTRATIVE SERVICES, PAYROLL ADMINISTRATION, TIME AND ATTENDANCE, BENEFIT ADMINISTRATION AND OTHER TRANSACTIONAL HUMAN RESOURCES FUNCTIONS, MAY BE TRANSFERRED TO THE OFFICE OF GENERAL SERVICES IN ACCORDANCE WITH THE PROVISIONS OF SECTION FORTY-FIVE OF THE CIVIL SERVICE LAW AS IF THE STATE HAD TAKEN OVER A PRIVATE ENTITY. NO EMPLOYEE WHO IS TRANSFERRED PURSUANT TO THIS SECTION SHALL SUFFER A REDUCTION IN BASIC ANNUAL SALARY AS A RESULT OF SUCH TRANSFER. S 2. This act shall take effect immediately.
