BILL NUMBER: S7537 TITLE OF BILL : An act to amend the public health law and the education law, in relation to allowing pharmacies to electronically transfer prescriptions to other pharmacies PURPOSE : To allow pharmacies to electronically transfer initial electronic prescriptions to other pharmacies. SUMMARY OF PROVISIONS : Section one amends § 281 of the public health law to authorize a pharmacy that is unable to fill an initial electronic prescription, to transfer that prescription electronically to another pharmacy. Section two amends § 6810 of the education law to authorize a pharmacy that is unable to fill an initial electronic prescription, to transfer that prescription electronically to another pharmacy. MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law and the education law, in relation to allowing pharmacies to electronically transfer prescriptions to other pharmacies THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 281 of the public health law is amended by adding a new subdivision 3-a to read as follows: 3-A. A PHARMACY THAT RECEIVES AN ELECTRONIC PRESCRIPTION FROM THE PERSON ISSUING THE PRESCRIPTION MAY IMMEDIATELY TRANSFER SUCH PRESCRIPTION TO AN ALTERNATIVE PHARMACY IF THE PHARMACY RECEIVING THE INITIAL PRESCRIPTION IS UNABLE TO FILL SUCH INITIAL PRESCRIPTION. S 2. Section 6810 of the education law is amended by adding a new subdivision 10-a to read as follows: 10-A. A PHARMACY THAT RECEIVES AN ELECTRONIC PRESCRIPTION FROM THE PERSON ISSUING THE PRESCRIPTION MAY IMMEDIATELY TRANSFER SUCH PRESCRIPTION TO AN ALTERNATIVE PHARMACY IF THE PHARMACY RECEIVING THE INITIAL PRESCRIPTION IS UNABLE TO FILL SUCH INITIAL PRESCRIPTION.
