AN ACT to amend the public health law, in relation to providing informa-
  tion on the availability of the influenza vaccine in  assisted  living
  facilities

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 207 of the public health law is amended by adding a
new subdivision 3-a to read as follows:
  3-A. (A) THE DEPARTMENT SHALL PROVIDE, AT NO COST TO EACH  ADULT  CARE
FACILITY,  ADULT  HOME,  ENRICHED HOUSING PROGRAM, RESIDENCE FOR ADULTS,
ASSISTED LIVING PROGRAM LICENSED  UNDER  ARTICLE  SEVEN  OF  THE  SOCIAL
SERVICES  LAW,  AND  ASSISTED  LIVING  RESIDENCE  LICENSED UNDER ARTICLE
FORTY-SIX-B OF THIS CHAPTER, IN AN EASILY PRINTABLE FORMAT,  INFORMATION
ABOUT  THE INFLUENZA VACCINE FOR OLDER ADULTS, INCLUDING BUT NOT LIMITED
TO: (1) THE ROLE THE INFLUENZA VACCINE PLAYS IN THE PREVENTION OF INFLU-
ENZA IN OLDER ADULTS; (2) THE HEALTH RISKS AND COMPLICATIONS  ASSOCIATED
WITH, AND THE MORBIDITY AND MORTALITY RATES AMONG OLDER ADULTS SUFFERING
FROM  INFLUENZA;  (3)  THE  AVAILABILITY  AND  EFFICACY OF THE INFLUENZA
VACCINE; (4) THE INDIVIDUAL AND COMMUNITY BENEFITS OF INOCULATING  OLDER
ADULTS  LIVING IN CLOSE PROXIMITY TO EACH OTHER, ESPECIALLY THOSE LIVING
IN ADULT CARE AND ASSISTED  LIVING  FACILITIES;  (5)  INFLUENZA  VACCINE
PROGRAMS  AND  HEALTH CARE PROVIDERS PROVIDING INFLUENZA VACCINATIONS TO
OLDER ADULTS; AND (6) ENCOURAGEMENT  THAT  ALL  RESIDENTS  IN  ALL  SUCH
FACILITIES CONSULT WITH THEIR HEALTH CARE PROVIDER CONCERNING THE ADMIN-
ISTRATION OF ADEQUATE DOSE OR DOSES OF INFLUENZA VACCINE.
  (B) THE DEPARTMENT SHALL REQUIRE EACH FACILITY OR ENTITY IDENTIFIED IN
PARAGRAPH  (A) OF THIS SUBDIVISION WHICH IS LOCATED IN THE STATE TO POST
THE INFORMATION IN A CONSPICUOUS PUBLIC  PLACE  IN  THE  FACILITIES,  BY
AUGUST  FIRST OF EACH YEAR. THE ASSISTED LIVING FACILITIES SHALL ALSO BE
REQUIRED TO PROVIDE THE  INFORMATION  TO  EACH  NEW  RESIDENT  WITHIN  A
REASONABLE TIME AND WITHOUT COST.
  S 2. This act shall take effect on the one hundred eightieth day after
it  shall  have become a law; provided however, that the commissioner of
health is authorized and directed to promulgate any rules or regulations
necessary for the timely implementation of this act on  or  before  such
date.
