 TITLE OF BILL :

An act to amend the state finance law, in relation to discretionary
buying thresholds

 PURPOSE :

To allow state agencies to purchase commodities or services from
preferred source providers in an amount not exceeding two hundred
thousand dollars without a formal competitive process.

 SUMMARY OF PROVISIONS :

Section 1 of this bill would amend State Finance Law § 163(6) to
broaden the $200,000 discretionary purchasing authority of state
agencies to include purchases of commodities and services from
preferred source providers. Section 2 provides that this act shall
take effect immediately.

 JUSTIFICATION :

Section 162 of the State Finance law provides that in order to advance
special social and economic goals, preferred sources must be
considered first. State agencies, political subdivisions or public

benefit corporations having their own purchasing agency are required
to purchase from a Preferred Source if it meets the entities', form,
function and utility. As the discretionary purchasing threshold has
increased for M/WBE's, Service Disabled Veterans and other groups the
preference provided to Preferred Sources has been diluted and put at
risk. Establishing a discretionary threshold for Preferred Sources to
be on par with M/WBE's and Service Disabled Veterans reminds
procurement officials that Preferred Sources are the first option for
procurement, for approved services and commodities, and allows for a
similar ease of use for procurement officials.

AN ACT to amend the state finance  law,  in  relation  to  discretionary
  buying thresholds

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 6 of section 163 of the state finance  law,  as
amended  by  chapter  569  of  the  laws  of 2015, is amended to read as
follows:
  6. Discretionary buying thresholds. Pursuant to guidelines established
by the state procurement council: the commissioner may purchase services
and commodities in an amount not exceeding eighty-five thousand  dollars
without  a  formal  competitive  process;  state  agencies  may purchase
services and commodities in  an  amount  not  exceeding  fifty  thousand
dollars  without  a  formal  competitive process; and state agencies may
purchase commodities or services from small business concerns  or  those
certified  pursuant  to articles fifteen-A and seventeen-B of the execu-
tive law, FROM  PREFERRED  SOURCE  PROVIDERS  PURSUANT  TO  SECTION  ONE
HUNDRED SIXTY-TWO OF THIS ARTICLE, or commodities or technology that are
recycled or remanufactured, or commodities that are food, including milk
and  milk products, grown, produced or harvested in New York state in an
amount not exceeding two  hundred  thousand  dollars  without  a  formal
competitive process.
  S  2. This act shall take effect immediately, provided that the amend-
ments to section 163 of the state finance law, made by  section  one  of
this  act,  shall  not affect the expiration and repeal of such section,
and shall expire and be deemed repealed therewith.
