BRINDISI -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law, in relation to sudden, unexpected death in epilepsy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 4210 of the public health law is amended by adding a new subdivision 5 to read as follows: 5. WHEN AN AUTOPSY OF THE BODY IS CONDUCTED OF A DECEASED HUMAN WHO HAS EPILEPSY OR A HISTORY OF SEIZURES IT SHALL INCLUDE AN INVESTIGATION AND DETERMINATIONS AS TO WHETHER THE DECEASED SUFFERED A SUDDEN UNEX- PECTED DEATH IN EPILEPSY, IN ACCORDANCE WITH STANDARDS ESTABLISHED BY THE COMMISSIONER. IN THE EVENT THE DECEASED DID SUFFER A SUDDEN, UNEX- PECTED DEATH IN EPILEPSY, SUCH INFORMATION SHALL BE NOTED ON THE MEDICAL CERTIFICATE AND BE REPORTED TO THE DEPARTMENT WITHIN THREE BUSINESS DAYS. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided, however, that effective immediate- ly, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date is authorized and directed to be made and completed on or before such effective date.
