AN ACT to amend the state finance law, in relation to prohibiting  state
  agencies  from  purchasing  hand  soap or cleaning products containing
  triclosan, triclocarban or derivatives of such antibacterial compounds

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 165 of the state finance law is amended by adding a
new subdivision 9 to read as follows:
  9.  PROHIBITION  ON  PURCHASE  OF HAND SOAP AND CLEANING PRODUCTS THAT
CONTAIN TRICLOSAN, TRICLOCARBAN, OR DERIVATIVES  OF  SUCH  ANTIBACTERIAL
COMPOUNDS.
  A.  EXCEPT  AS HEREINAFTER PROVIDED, THE STATE AND ANY STATE AUTHORITY
AS SUCH TERM IS DEFINED IN SUBDIVISION ONE OF SECTION TWO OF THE  PUBLIC
AUTHORITIES  LAW  SHALL  NOT PURCHASE OR OBTAIN FOR ANY PURPOSE ANY HAND
SOAP AND CLEANING PRODUCTS  THAT  CONTAIN  TRICLOSAN,  TRICLOCARBAN,  OR
DERIVATIVES OF SUCH ANTIBACTERIAL COMPOUNDS, WHOLESALE OR RETAIL, IN ANY
FORM.
  B.  THE  PROVISIONS OF PARAGRAPH A OF THIS SUBDIVISION SHALL NOT APPLY
TO:
  (I) THE PURCHASE OF HAND  SOAP  AND  CLEANING  PRODUCTS  THAT  CONTAIN
TRICLOSAN,  TRICLOCARBAN, OR DERIVATIVES OF SUCH ANTIBACTERIAL COMPOUNDS
THAT ARE USED SOLELY IN MEDICAL FACILITIES; OR
  (II) ANY BINDING CONTRACTUAL OBLIGATIONS FOR PURCHASE  OF  COMMODITIES
ENTERED INTO PRIOR TO THE EFFECTIVE DATE OF THIS SUBDIVISION.
  S  2.  This  act  shall take effect one year from the date on which it
shall have become a law.
