LUPARDO, FAHY -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the use of school buildings for school age child care THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 409 of the education law is amended by adding a new subdivision 3 to read as follows: 3. NOTWITHSTANDING THE PROVISIONS OF ANY OTHER LAW, RULE OR REGU- LATION, THE RULES AND REGULATIONS PROMULGATED IN ACCORDANCE WITH THIS SECTION SHALL PREEMPT ANY CONTRADICTORY REGULATIONS PROMULGATED BY ANOTHER STATE AGENCY, RELATING TO THE USE OF A SCHOOL BUILDING BY A REGISTERED THIRD PARTY PROVIDING SCHOOL AGE CHILD CARE AS DEFINED IN PARAGRAPH (F) OF SUBDIVISION ONE OF SECTION THREE HUNDRED NINETY OF THE SOCIAL SERVICES LAW.
