AN ACT to amend the alcoholic beverage control law, in relation to char-
  ity sponsored events

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 6 of section  106  of  the  alcoholic  beverage
control  law,  as amended by chapter 919 of the laws of 1986, is amended
to read as follows:
  6. No person licensed to sell  alcoholic  beverages  shall  suffer  or
permit  any  gambling on the licensed premises, or suffer or permit such
premises to become disorderly. The use of the licensed premises, or  any
part thereof, for the sale of lottery tickets, playing of bingo or games
of chance, [or] as a simulcast facility or simulcast theater pursuant to
the  racing,  pari-mutuel  wagering and breeding law, OR FOR THE SALE OF
TICKETS RELATED TO A CHARITY SPONSORED EVENT NOT  TAKING  PLACE  ON  THE
PREMISES  OF  THE  LICENSEE, when duly authorized and lawfully conducted
thereon, shall not constitute gambling within the meaning of this subdi-
vision.  IN THE CASE OF A CHARITY SPONSORED EVENT, THE LICENSEE SHALL BE
PERMITTED TWO SUCH EVENTS ANNUALLY, AND THE LICENSEE  SHALL  NOTIFY  THE
AUTHORITY  OF SUCH EVENT THIRTY DAYS PRIOR TO THE SALE OF ANY SUCH TICK-
ETS. FOR PURPOSES OF THIS  SUBDIVISION,  CHARITABLE  ORGANIZATION  SHALL
MEAN  A CHARITY ORGANIZED UNDER THE NON-PROFIT OR NOT-FOR-PROFIT LAWS OF
THIS STATE, AND POSSESSING A FEDERAL TAX EXEMPTION UNDER SECTION  501(C)
OF THE INTERNAL REVENUE CODE OF THE UNITED STATES.
  S 2. This act shall take effect immediately.
