SIMOTAS, O'DONNELL -- read once and referred to the Committee on Judiciary AN ACT to amend the civil practice law and rules, in relation to special proceedings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (b) of section 506 of the civil practice law and rules is amended by adding a new paragraph 5 to read as follows: 5. A PROCEEDING BROUGHT PURSUANT TO SUBDIVISION TWO OF SECTION TWO HUNDRED FIFTY-NINE-I OF THE EXECUTIVE LAW MAY COMMENCE IN THE SUPREME COURT IN THE COUNTY OF CONVICTION OF THE PETITIONER. S 2. This act shall take effect ninety days after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11354-01-5
