LUPARDO -- read once and referred to the Commit- tee on Economic Development AN ACT to amend the alcoholic beverage control law, in relation to the consumption of alcohol by students under the age of twenty-one who are enrolled in certain courses of study THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5 of section 65 of the alcoholic beverage control law, as amended by chapter 107 of the laws of 1986, is amended to read as follows: 5. The provisions of subdivision one of this section shall not apply to a person who gives or causes to be given any such alcoholic beverage to a person under the age of twenty-one years, who is a student in a curriculum licensed or registered by the state education department and is required to taste or imbibe alcoholic beverages in courses which are part of the required curriculum, provided such alcoholic beverages are used only for instructional purposes during [classes] ON-CAMPUS OR OFF- CAMPUS COURSES conducted pursuant to such curriculum. S 2. Paragraph (a) of subdivision 2 of section 65-c of the alcoholic beverage control law, as added by chapter 592 of the laws of 1989, is amended to read as follows: (a) to a person who is a student in a curriculum licensed or regis- tered by the state education department and the student is required to taste or imbibe alcoholic beverages in ON-CAMPUS OR OFF-CAMPUS courses which are a part of the required curriculum, provided such alcoholic beverages are used only for instructional purposes during class conducted pursuant to such curriculum; or S 3.
