BILL NUMBER:S3178 TITLE OF BILL: An act to amend the penal law, in relation to establishing the felony offenses of aggravated assault and manslaughter in the third degree PURPOSE: Enacts "Idelfonso Romero's law" to establish the new felony offenses of aggravated assault and manslaughter in the third degree. SUMMARY OF PROVISIONS: Section 1: Provides that the law shall be called "Idelfonso Romero's law" Section 2: Adds a new section 120.00-a to the penal law creating the new class E felony of aggravated assault to apply when a person commits the current A misdemeanor offense of assault in the third degree and the result is a serious physical injury to another person. Section 3: Adds a new section 125.14-a to the penal law creating a new third degree level of manslaughter, a class D felony, to apply when a person intends to cause a physical injury to another person and the result is the death of such person or a third person.

KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to establishing the felony offenses of aggravated assault and manslaughter in the third degree THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Short title. This act shall be known and may be cited as "Ildefonso Romero's law". S 2. The penal law is amended by adding a new section 120.00-a to read as follows: S 120.00-A AGGRAVATED ASSAULT. A PERSON IS GUILTY OF AGGRAVATED ASSAULT WHEN: 1. WITH INTENT TO CAUSE PHYSICAL INJURY TO ANOTHER PERSON, HE OR SHE CAUSES SERIOUS PHYSICAL INJURY TO SUCH PERSON OR TO A THIRD PERSON; OR 2. HE OR SHE RECKLESSLY CAUSES SERIOUS PHYSICAL INJURY TO ANOTHER PERSON; OR 3. WITH CRIMINAL NEGLIGENCE, HE OR SHE CAUSES SERIOUS PHYSICAL INJURY TO ANOTHER PERSON BY MEANS OF A DEADLY WEAPON OR A DANGEROUS INSTRUMENT. AGGRAVATED ASSAULT IS A CLASS E FELONY. S 3. The penal law is amended by adding a new section 125.14-a to read as follows: S 125.14-A MANSLAUGHTER IN THE THIRD DEGREE. A PERSON IS GUILTY OF MANSLAUGHTER IN THE THIRD DEGREE WHEN, WITH INTENT TO CAUSE PHYSICAL INJURY TO ANOTHER PERSON, HE OR SHE CAUSES THE DEATH OF SUCH PERSON OR OF A THIRD PERSON. MANSLAUGHTER IN THE THIRD DEGREE IS A CLASS D FELONY. S 4. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
