BILL NUMBER:S4085 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to the definition of "for cause" revocation of licenses PURPOSE OR GENERAL IDEA OF THE BILL: SUMMARY OF SPECIFIC PROVISIONS: Section 1. Subdivision 3 of section 118 of the alcoholic beverage control law, as added by chapter 536 of the laws of 1996, is amended to read as follows: 3. (A) As used in this section, the term "for cause" shall also include the existence of a sustained and continuing pattern of noise, disturb- ance, misconduct, or disorder on or about the licensed premises, related to the operation of the premises or the conduct of its patrons, which adversely affects the health, welfare or safety of the inhabitants of the area in which such licensed premises are located. (B) As used in this section, the term "for cause" shall also include deliberately misleading the authority on the nature of the business to be operated on the licensed premises or changing the nature of the busi- ness at the licensed premises during the licensing period without seek-

BILL NUMBER: S4085A TITLE OF BILL : An act to amend the alcoholic beverage control law, in relation to the definition of "for cause" revocation of licenses PURPOSE OR GENERAL IDEA OF THE BILL : To enable the State Liquor Authority (SLA) to revoke, cancel, suspend or impose a civil fine on a business that obtains a license to sell alcoholic beverages, for on-premises consumption, and the nature of the business substantially changes in a manner that clearly and substantially increases the incidence of local crime, nuisances or disturbances and endangers the public health, safety and welfare of the residents of the area where such establishment is located. SUMMARY OF SPECIFIC PROVISIONS : Section 1. Alcoholic Beverage Control Law (ABC) section 118(3) is amended to expand the definition of the term "for cause" to include changes in a business' operations that are substantial, and which endanger general health, safety and welfare of local residents, and such changes in the operation of such establishment were not contemplated when such application was approved by the SLA.

BILL NUMBER: S4085B TITLE OF BILL : An act to amend the alcoholic beverage control law, in relation to the definition of "for cause" revocation of licenses PURPOSE OR GENERAL IDEA OF THE BILL : To enable the State Liquor Authority (SLA) to revoke, cancel, or suspend the license of a business that sells alcoholic beverages, for on-premises consumption, when: a) such licensee when applying for a license deliberately mislead the authority on the true nature of the business to be conducted, or b) the business activities of such business substantially expands over time in a manner that clearly increases the incidence of local crime or disorderly conduct. SUMMARY OF SPECIFIC PROVISIONS : Section 1. Alcoholic Beverage Control Law (ABC) section 118(3) is amended to expand the definition of the term "for cause" to include two new reasons to revoke, cancel, or suspend such businesses' on-premises alcoholic beverage license. Under this bill, there are two ways in which the "for cause" criteria can be triggered to start proceedings to revoke, cancel, suspend, or impose a civil fine on an establishment.
