BILL NUMBER: S6815 TITLE OF BILL : An act to amend the penal law, in relation to increasing the severity of the penalties for directing a laser at an aircraft offenses PURPOSE : To provide state and local law enforcement officials greater authority in preventing and punishing individuals who direct laser pointers at aircraft. SUMMARY OF PROVISIONS : Section 1 establishes the directing of a laser pointer at an aircraft in the second degree as a class D felony. Section 2 establishes the directing of a laser pointer at an aircraft in the first degree as a class B felony. Section 3 sets the effective date. JUSTIFICATION : Recently, pilots have reported a spate of incidents regarding the intentional shining of laser pointers into the cockpit of aircraft. This is unacceptable and dangerous. There seems to be no benefit to performing such an act that doesn't include an accident involving the aircraft. This could result in the loss of hundreds of lives. GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to increasing the severity of the penalties for directing a laser at an aircraft offenses THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The closing paragraph of section 240.76 of the penal law, as added by chapter 98 of the laws of 2014, is amended to read as follows: Directing a laser at an aircraft IN THE SECOND DEGREE is a class [A misdemeanor] D FELONY. S 2. The closing paragraph of section 240.77 of the penal law, as added by chapter 98 of the laws of 2014, is amended to read as follows: Directing a laser at an aircraft in the first degree is a class [E] B felony. S 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13182-02-5
